Construction labor subcontracting refers to the activities of construction enterprises or specialized contracting enterprises that contract labor services in housing construction and municipal infrastructure projects to labor subcontracting enterprises with corresponding qualifications. In labor subcontracting, the labor contract relationship between the labor service employer and the labor subcontractor is based on the agreement, and the labor subcontractor performs the obligations of the labor contract to the labor service employer through the construction and labor service activities of the labor personnel employed, and the labor service employer pays the agreed labor remuneration to the labor subcontractor. In addition, there is an employment relationship between the labor subcontractor and the labor personnel, while there is generally no direct relationship between the labor employer and the labor personnel.
